Suppressor law
Carve-out in flux
Legal, but the state exception is written for federally registered owners. Since the ATF's October 9, 2026 policy, new purchases cannot register — the statute is untested for them.
| Statute | IC 35-47-8.5-1 to -8.5-5 (federal-process certification duty only); IC 35-47-5-10(9) |
| Notes | The words 'silencer'/'suppressor' appear nowhere in IC Title 35, Art. 47 (text-verified against the Indiana Code 2026 edition; 'Ch. 8.5. NFA Firearm Certification' is the only NFA-related chapter and imposes no state approval). A suppressor is a 'firearm accessory' under IC 35-47-1-5.1(2), and IC 35-47-11.1 preempts local firearm-accessory regulation. Indiana 'destructive device' (IC 35-47.5-2-4, 2026 ed.) covers explosives/incendiaries and >1/2-inch-bore weapons, not suppressors. IC 35-47-5-10(9) (amended P.L.80-2023) keys the machine-gun offenses to NFRTR registration; post-Oct 9, 2026 ATF guidance, suppressors are not required to be registered in the NFRTR, so the exception affirmatively covers them. 'Machine gun' is defined at IC 35-31.5-2-190 (multi-shot-per-trigger-pull weapon); that definition's text was NOT verified from a primary source this run (iga.in.gov section URL 404, Justia 504) and is non-load-bearing because of 35-47-5-10(9)(B). All statutes read from Indiana Code 2026 PDFs at iga.in.gov fetched 2026-10-14; the 2026 edition already incorporates 2026 session laws (e.g., P.L.152-2026 repeal notes). |
| Hunting | Legal. IN DNR: 'hunters are allowed to use firearms with suppressors to hunt deer if they are also following federal regulations to possess a suppressor.' IC 14-22-38-4(d) and IC 14-22-38-4.5 penalize using/possessing a silencer only while committing an unlawful deer/turkey take or trespass hunting offense. |
Federal context: suppressor tax $0 since Jan 1, 2026 (OBBBA); ATF stopped enforcing NFA approval/registration Oct 9, 2026. State law is unchanged and independently controls.
