Suppressor law
Prohibited
Possession is a state-law crime here regardless of the federal change. No NFA-registration exemption exists in this state's law.
| Statute | 720 ILCS 5/24-1(a)(6), 24-1(b), 24-1(c)(1); 24-2(g-5), (g-7); 430 ILCS 65 (no silencer provision) |
| Notes | Gap (2) resolved - the 'IL legalized suppressors in 2013' prior note is incorrect. Current 720 ILCS 5/24-1(a)(6) makes possession of 'any device or attachment... designed, used or intended for use in silencing the report of any firearm' unlawful use of weapons with NO FOID-based or federal-compliance exception; the FOID Act (430 ILCS 65) contains no silencer provision. NRA-ILA current summary: 'Suppressors: Firearm suppressors are illegal for ownership, possession, and use in Illinois.' The 2012-2013 acts (P.A. 97-0676; P.A. 98-0364 era) added only the narrow manufacturers' exemption 24-2(g-5). Illinois is one of 8 states with a civilian suppressor ban (CA, DE, HI, IL, MA, NJ, NY, RI). |
| Hunting | Prohibited - silencer possession itself is a Class 3 felony (Class 2, 3-7 years, in schools/parks/public transit/within 1,000 feet thereof under 24-1(c)(1)); no lawful hunting use. |
Federal context: suppressor tax $0 since Jan 1, 2026 (OBBBA); ATF stopped enforcing NFA approval/registration Oct 9, 2026. State law is unchanged and independently controls.
