Suppressor law
Carve-out in flux
Legal, but the state exception is written for federally registered owners. Since the ATF's October 9, 2026 policy, new purchases cannot register — the statute is untested for them.
| Statute | C.R.S. 18-12-102(1), (3), (5) |
| Notes | Silencer is a 'dangerous weapon' under 18-12-102(1); knowing possession is a class 5 felony (3) absent the (5) affirmative defense. Prior-run hunting cite 33-6-125 was the wrong section (it is 'possession of a loaded firearm in a motor vehicle' - saved extract confirms). Wrinkle: since Oct 9 2026 ATF no longer registers covered suppressors, so post-Oct-2026 acquisitions may not qualify for the registration-keyed affirmative defense until Colorado amends 18-12-102 - unresolved gap; 2023/2025 amendments left the silencer treatment intact. |
| Hunting | Legal - CPW manner-of-take regulation (2 CCR 406-3-303) does not prohibit suppressors; no statute bars hunting with silencers. |
Federal context: suppressor tax $0 since Jan 1, 2026 (OBBBA); ATF stopped enforcing NFA approval/registration Oct 9, 2026. State law is unchanged and independently controls.
