The Supreme Court of Ohio held that a sentencing court selects the single firearm specification to impose when multiple specifications attach to one felony.
In State v. Holliman, Slip Opinion No. 2026-Ohio-4232, the court affirmed the Eighth District. Under R.C. 2929.14(B)(1)(a), the trial court—not the prosecution—selects which one of multiple firearm specifications to impose for a single felony. In Holliman, the court imposed the one-year specification rather than the three-year specification.
