New Jersey lost its AR-15 and magazine-ban case 10–5 in federal appeals court. On October 1 it filed No. 26-452 asking SCOTUS to erase that win after it rules in the December cases.
The petition asks the Court to hold New Jersey's case until it rules in Viramontes v. Cook County and Grant v. Higgins — the consolidated AR-15 cases argued December 2 — then send it back down.
Because the petition also raises New Jersey's magazine limit, the magazine fight is next in line behind the AR-15 cases.
New Jersey gun owners won fair and square below. The state wants a mulligan from a friendlier panel. We'll be watching how the Court treats it.
