The final rule published October 27 lets federally licensed firearms dealers use the FBI’s NICS for voluntary employment background checks of certain current or prospective employees; it takes effect November 27.

On October 27, 2026, the Department of Justice published a final rule authorizing federal firearms licensees (FFLs) to use the FBI’s National Instant Criminal Background Check System (NICS) for voluntary employment background checks of certain eligible current or prospective FFL employees.

The rule requires written consent from the employee and does not require an FFL to submit these checks. The rule states that it does not obligate State, local, and Tribal governmental entities to respond to FHC-related requests. It takes effect November 27, 2026.

The official rule is Federal Register Document 2026-21920, 91 FR 67460. It is a nationwide rule for qualifying FFLs, including FFLs in Ohio; it does not amend Ohio carry law. Not legal advice. Verify current federal and state requirements before acting.
